Judge orders state to turn over emails sought in lawsuit over ban on care for transgender children

Federal Judge James Moody has rejected Attorney General Leslie Rutledge’s attempt to block giving plaintiffs in the transgender care suit emails about transgender issues.

At a hearing yesterday, he seemed to indicate he was leaning in this direction. The plaintiffs, led by the ACLU, have run into resistance from legislators on their communications as well.

Plaintiffs particularly want to see what Rutledge and correspondents have said about another piece of anti-transgender legislation, to bar participation in girls’ sports. (Reverse trans participation was not targeted.) Rutledge’s office said these communications weren’t relevant. From yesterday’s hearing:

Judge Moody didn’t seem convinced. If those emails contain discussions about transgender people or issues, they’re relevant, Moody said. “Are you telling me the GIRLS Act has nothing to do with transgender people?”
